Divorce
The first party to file for the divorce is called the "Petitioner" and the person who is served is the "Respondent." Practically speaking, there is no special advantage to being the first to file. California law provides that the parties must wait at least 6 months from the date the Respondent is served with the divorce papers.
All the issues in a divorce can be resolved much sooner and an agreement can be drafted, signed by the parties, presented to the court, signed by the judge and be entered as a divorce judgment prior to the 6 month requirement. The judgment may become truly final and effective upon 6 months and 1 day from the first service of the petition, and the parties will be free to remarry at that time.
